REACH is a new European Community Regulation (EC 1907/2006) on chemicals and their safe use which became European Law on June 1st, 2007. The EU’s Registration, Evaluation, Authorization and Restriction of Chemicals (REACH) regulation is the latest in a rapidly growing list of environmental regulations across the globe. REACH targets hazardous substances in products, termed substances of very high concern (SVHC), and bans thousands of chemicals used in a wide variety of products. The aim of REACH is to improve the protection of human health and the environment through the better and earlier identification of the intrinsic properties of chemical substances. The Regulation also calls for the progressive substitution of the most dangerous chemicals when suitable alternatives have been identified. A failure to demonstrate compliance with REACH can have severe consequences that can threaten product viability and revenue. REACH provisions will be phased-in over 11 years.
The European Chemical Agency (ECHA) has published the SVHC Candidate List. Once a substance is added to the Candidate List, REACH imposes immediate obligations on manufacturers and importers to declare the substances if present. Article 33(1) of the REACH Regulation states that manufacturers and importers of articles (products) are required to notify their customers of the presence of any Substances of Very High Concern (SVHC) in their products exceeding 0.1% by weight and provide instructions on safe use of the product.
